The present delivery and return conditions are an integral part of the General Terms and Conditions of Sale of CAHU, within which they are contained in articles 10 and 11.
In the event of any discrepancy between these Terms of Delivery and Return and the General Terms and Conditions of Sale, it is expressly provided that the General Terms and Conditions of Sale shall prevail.
Terms of Delivery
The Delivery intervenes, according to the choice of the Purchaser,
either by the withdrawal of the Articles at the point of withdrawal located at the address: 38 rue Lucien Sampaix - 75010 PARIS;
or by the reception of the Articles at the postal address indicated at the time of the Order.
CAHU delivers the Products in France and abroad to any valid address.
The amount of the delivery charges depends on the amount of the Order and the delivery method chosen by the Buyer. The Buyer is informed of this during the Order process, prior to its final validation.
The Delivery charges applicable to the Order are those mentioned on the Site at the time of the Order in the "Delivery and Returns" section.
CAHU shall use its best efforts to deliver the Orders within a maximum of :
twelve (12) working days for delivery in Metropolitan France;
Twenty (20) working days for delivery in French overseas territories or abroad.
Delivery times are in working days and run from the first working day following the validation of the Order.
In order for these deadlines to be met, Buyer must ensure that he/she has provided accurate and complete information concerning the Delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).
The Buyer may follow the progress of the processing of its Order in the space reserved for this purpose on the Site or by mail at email@example.com.
CAHU shall use its best efforts to ensure that the Order is prepared and delivered to the carrier within an average of one (1) to five (5) business day(s) as of the day following the day on which the Customer validates the Order.
Deliveries shall be made by CHRONOPOST, TNT, DHL, UPS or any other carrier chosen at CAHU's discretion at the time of shipment of the Order, from Monday to Saturday.
Buyer expressly acknowledges that, once CAHU undertakes the delivery of the Items ordered, the risk of loss or damage to the Items is transferred to Buyer at the time of Delivery.
Delay and impossibility of Delivery
In case of delay of Delivery and as long as the Delivery of the Items is not effective, the Buyer may request the cancellation of the sale to CAHU by sending an email to the address: firstname.lastname@example.org specifying:
the number of the Order concerned;
the reason for the return
the Order tracking number.
In the event that the Order has not yet been shipped upon receipt by CAHU of the notice of cancellation of the Customer's Order, the Delivery will be blocked by CAHU and the Customer will be entitled to a refund of any sums debited within a period of thirty (30) days following receipt by CAHU of the registered letter with acknowledgement of receipt containing the Customer's notice of cancellation.
In the event that the Order has already been shipped upon receipt, it is the responsibility of the Customer to refuse the package. CAHU will then proceed with the reimbursement of any sums debited within thirty (30) days following receipt of the return of the refused package, complete and in its original condition.
Notwithstanding the foregoing, CAHU shall not be liable for any damages resulting from a delay in delivery, and only the reimbursement of the Items and the delivery charges shall be possible, to the exclusion of any other form of compensation.
In the event that the Delivery cannot be made due to an incorrect delivery address or failure of the Buyer to collect the Order from the collection point, no reshipment shall be made and the Buyer shall be reimbursed within sixty (60) days from the date of receipt of the Order by CAHU.
Receipt of the Order
Upon receipt of the Order, the User is required to check the condition of the Items. It is the User's responsibility to make any reservations and claims he/she deems necessary, or to refuse the package if it is obviously damaged. The aforementioned reserves and complaints must be addressed to the conveyor by registered letter with request for acknowledgement of delivery in the three working days following the delivery date of the Articles. The Buyer shall also send a copy of this letter to CAHU.
Failure to file a claim within the aforementioned period shall extinguish any action against the carrier in accordance with Article L.133-3 of the French Commercial Code.
Sending an invoice to the User
The archiving of purchase orders and invoices is made on a reliable and durable support.
The Buyer may obtain a copy of the invoice(s) corresponding to his/her Order(s) by sending a request by email to email@example.com.
RIGHT OF WITHDRAWAL - RETURN AND REFUND
Time limit and terms for exercising the right of withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the Buyer has a period of fourteen (14) days from the date of receipt of the Order to exercise his/her right of withdrawal from CAHU, without having to justify his/her decision. After this fourteen (14) day period, the sale is firm and final.
The exercise of the right of withdrawal can be done by completing and sending the model withdrawal form in the Appendix of the General Conditions, by mail, to the following address CAHU,
The exercise of the right of withdrawal can also be done by sending an email to firstname.lastname@example.org, containing :
an unambiguous statement expressing its desire to withdraw;
the number of the Order concerned.
The Buyer may not exercise his right of withdrawal for an Article made to his specifications, used, washed, damaged or unsealed.
Terms and conditions for returning the Order within the framework of the right of withdrawal
The right of withdrawal is exercised without penalty.
The Buyer shall return the Order within fourteen (14) days following the communication of his decision to withdraw, in accordance with Article L.221-21 of the French Consumer Code.
The Article(s) must be returned to CAHU (CAHU, 38 rue Lucien Sampaix - 75010 Paris) in its (their) original packaging, in its (their) original, new, unwashed condition.
Upon receipt of the package, CAHU will judge the perfect condition of the returned item(s). No return will be accepted if the returned Item(s) has (have) been visibly used or damaged by the Buyer, such use or damage rendering the Item(s) unfit for sale.
If the return is refused by CAHU for the reasons set forth above, the Item(s) shall be returned to the Buyer at the Buyer's expense without the Buyer being able to claim any compensation or right to reimbursement, with the exception of the subsequent exercise of its warranty rights on the Items.
The return of the Articles is with the load and the risks of the Purchaser.
Refund of Items returned under the right of withdrawal
CAHU shall refund the Order within fourteen (14) days of the date on which it is informed of the Customer's decision to withdraw, provided that the Customer has received the Article(s) subject to the right of withdrawal within this period. In the event that the Article(s) subject to the right of withdrawal have not been received within this period, CAHU will defer reimbursement until full receipt of the said Article(s).
CAHU will issue the refund using the same payment method that was used to pay for the Order. If this means of payment has expired, the Purchaser must contact customer service to change the method of reimbursement. CAHU shall not be liable for any delay in the refund.
The refund of an order paid with a gift card or a credit note will be automatically made in credit note.
If the Customer fails to comply with these Terms and Conditions, CAHU will not be able to refund the item(s) concerned.
